Recommending Mediation

Recommending Mediation is a non confidential process done primarily in San Mateo County but it can be done in other counties as long as the parties so stipulate.

What is the process?

Recommending Mediation begins with a phone conference with the attorneys who describe the referral questions.

Typically commences with individual interviews of the parents.

The specific issues to be mediated are stated in the document stipulation.

All of this is memorialized for review in the mediation process.

Making an effort to come to agreement on all issues.

Drafting agreements as we proceed.

If the parents are unable to reach agreement,

a limited investigation will occur.

NOTE: Under certain circumstances the child(ren) and contact professional collaterals may be involved.

The result of the Recommending Mediation is a report which will state all agreements and on areas of
disagreement make specific recommendations on the issues that were not resolved in the mediation.

Recommending Mediation is a time limited process and does not proceed over time with an open ended appointment (those types of matters are best served in Parenting Coordination). In some appropriate cases it may include a follow up mediation with additional investigation and further recommendations.
